In exercise of the powers conferred by clause (8) of Section 2 of the A.P.P.R.Act, 1994, the Governor of AndhraPradesh authorizes the Commissioner Panchayat Raj to exercise any of the powers or discharge any of the duties of the Commissioner under this Act.
The Commissioner may by notification authorize any officer or person to exercise any of the powers vested by or under this Act in the commissioner as the case may be and may in like manner withdraw such authority.
The exercise of any power conferred on the Commissioner by any of the provisions of this Act, including sub sec. (2) and (3) of this section shall whether such power is exercised by the Commissioner or the District Collector himself or by any person to whom it has been delegated under Sub Section (2) be also to control by the Government or any such person as may be empowered by them in this behalf. The Government shall also have power to control and revise acts or proceedings of any persons so empowered.
To inspect all Zilla Parishads once in a Calendar year and submit copies of inspection notes for review by Government.
Inspection: The Commissioner, Panchayat Raj or any other Officer authorized by him shall be competent to enter upon and inspect any Institution, school, centre, work or scheme being implemented by the Zilla Parishad or Mandal Parishad and shall be competent to call for and obtain any information return, statement, records files etc., relating to the subject for examination and scrutiny.
Commissioner of Panchayat Raj is empowered to initiate disciplinary action against the officers disobeying these orders.
Subject to such control as may be prescribed, the Government/the Commissioner or the District Collector may, in case of emergency, direct or provide for the execution of any work, or the doing of any act which a gram panchayat or executive authority is empowered to execute or do, and the immediate execution or doing of which is, in his opinion necessary for the safety of the public and may direct that the expense of executing such work or doing such act shall be paid by the person having the custody of the gram panchayat fund in priority to any other charges against such fund except charges for the service of authorized loans.
In every case in which the powers are conferred by Section 262 of the Act, the Government, the Commissioner or the District Collector are empowered to exercise or get executed any work which is in their opinion necessary for the safety of public. If such power exercised by Commissioner, he shall forthwith report to the Government within 15 days along with reasons specified therein, with a copy to the District Collector concerned.
The Commissioner shall supervise the administration, powers of inspectionary and superintending officers and of the Government of all Gram Panchayats in the State and shall also exercise the powers and perform the functions vested in him by or under this Act.
